This is a legally binding document. By commissioning me you expressly understand and agree to the Terms of service and conditions provided in this document.It is the client's job to read this T.O.S. and understand them, therefore agree with them before commissioning me. If any rule is broken appropriate action will be taken and may result in a blacklist
(you will not be able to commission or buy from me again.)These terms will be updating time to time - in case of drastic changes that would impact
past commissioners, you will be contacted and updated.If there is dissatisfaction after the commission is completed, I take no responsibility and
will not refund as it can be avoided by reading the T.O.S. fully.//Last edit: 17/10/2023//I. GENERAL TERMS.Please write in a clear and nice manner.

Any ill behaviour will not be tolerated and your commission will be canceled if it occurs.
Follow the rules provided in the commission journal, YCH or Adoptable deviation.
If you fail to follow the rules provided I have the right to decline your commission.II. PAYMENTFull payment is taken upfront only via PayPal invoicing for the agreed upon price,
(unless we specifically agreed on another form of payment), before the commission is started.I do not take crypto currency or currency used on specific sites (ex. amino coins, dA points).
Illegaly filing a charge-back on Paypal after or during completion will result in me contacting Paypal personally. (Paypal's invoice T.O.S. section will force a refund to me as well as grant you a ban and possibly termination of your account).The currency accepted is EURO and USD.III. PROCESSWhen commissioning me, please state exactly what you wish for (poses, type of scenery, colors, expressions etc.). Additional information not mentioned beforehand may cost extra to add within the commission.I will only fix minor things on the final piece in the timespan of 14 days after it's finalization
- after that I will decline changes. Please make sure to go over your commission after sending the finalized version to see if anything must be changed.Fixes will not apply (or will be charged to change) to things such as personal character design changes that deviate from the agreed upon character sheet, complex addons, change of posture or scenery and generally larger changes that were not agreed upon etc. if the piece is already in a certain stage of progress.Relay ALL details of the commission before we agree on a price. If you want to change ANYTHING after we already agreed on a price and you've paid, I will increase the price accordingly (based on current progress and amount of time I may need to apply changes), for any specifications that might have been added to the commission details.I generally deliver a sketch phase beforehand for the client to confirm the details before I proceed, but the client should always classify if they wish to see each stage of the progress.(If asked) During sketching process, you may ask for revisions and changes without extra pay, unless the total amount of time you have asked for bigger changes (such as different character positions or scenery) exceeds 3 revisions after detailed information was given for the sketchI recommend providing me with a reference sheet picture and not multiple commissioned pictures/written descriptions, for a more accurate finished piece. (Price may rise if working off description; this excludes custom designs.)IV. CHARACTER OWNERSHIPThe character that will be commissioned must belong to you or you must have permission to be allowed to commission them. If you plan on gifting a commission to someone else with their character(s), you must have their permission to commission their character (You do not have to specify it is a gift, but you must have some confirmation that they are allowing you to commission art of their character).V. COPYRIGHT / USAGE POLICYI, the artist, hold every right to the produced drawing /design, not the commissioner.Therefore I´m allowed to use the copyrighted artwork/design to;
-Promote myself with in any place or site.
-Publish in books/literature
-To display it anywhere to my liking.
-Post it wherever I want.The commissioner are allowed to;
-Use the copyrighted artwork/design for personal use only unless agreed otherwise.
-Print the artwork, and claim the right of their character(s) but not the drawing itself.
-Use the artwork/design to promote themselves with proper credit given to the artist.If you break the copyright infringement in any way, every right you had to the drawing will be retracted.The following is considered Copyright infringement:Reproducing/using the copyrighted artwork/design commercially. (Meaning making money of it in any way)
Taking Credit for the creation of the artwork/design.
Removing any watermarks/signatures.
altering the artwork/design without my, the artist´s, consent.A Purchase of Commercial rights to the artwork/design will always be 300% of original price.
With commercial rights you are allowed to make any sort of merch with the artwork/design.
Use it in books, covers, as Props, change it to your liking and promote your own brand with.
Credit is still required for usage of the (original) artwork/design, even if altered or edited.VI. CANCELING/REFUNDING POLICYIf I cannot start a commission that has already been fully paid for, you will receive a full refund.You may switch the character/theme for me to re-attempt the commission unless stated otherwise.If I have already began the commission and am in the process, the client will not be able to receive a refund or will only receive a partial refund. This is done only in the case where a client asks for a refund.
You will also receive whatever W.I.P. of the commission I have created so far.I have the right to cancel and refund the money for your commission at any time.
You have no right to cancel or demand a refund from the artist under any circumstances after payment are received.
If money has not been sent yet the commissioner has the right to cancel the commission.If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.
You will forbidden to ever commission me, Amanska, ever again.
Your name will be publicly posted everywhere I want to for others to watch out for.
I also have every right to file a complaint and I have all the right to the money you have given me.Any statement can be bound to change if discussed with me, the artist, prior to the commission.You agree that the artwork created for this commission is not to be altered in any fashion unless written permission by the artist is given if the artwork is shared online. (ex: cutting out the signature and so on.) You agree that the artwork being created for any and all commissions made by The Artist (at any stage of completion) will not be put onto or used by any and all past, present and future blockchain-associated technologies, all past, present or future NFT marketplaces, made into NFTS or Cryptocurrencies under ANY AND ALL circumstances at any time. This also goes for feeding/uploading a work to any AI-driven websites for reporoducing or modifying art. This includes all past, present and future derivatives, versions, evolutions of these prior mentioned technologies, selling platforms or trading/investing spaces; this includes public or private websites and/or mobile applications. The commercial use of personal, individual use labeled commissioned artwork in any shape or form without the strict written permission by The Artist is prohibited. This includes actions performed by means such as a bot or human decision. If it is discovered that a client uses any past, present or future commissioned artwork created by Amanska (@Amanska) as an NFT, AI or Cryptocurrency in any form whatsoever at any time; the client shall:Be banned from using Amanska's services. Pay Amanska (@Amanska) the entire amount earned from NFT and Cryptocurrency sales (using a regulated, government recognized currency; preferably in USD or CAD via PayPal or Interac E-Transfer)Have their commission removed from Amanska's public art hosting services.VII. -Non-original fandom charactersVIII. CHANGES IN TOS
It may happen that in the future I will need to update my TOS. I want to make it clear that any changes will apply to any commissions made after the updated TOS. If you received a work before the change, the old TOS still applies to you.
If a TOS is updated because of a major change that impacts previous customers, I will be in contact to ask if they agree to the new TOS. If they choose not to agree we will discuss the next possible outcome.IX. ADOPTABLES SPECIFICYou are not allowed to ever make designs made by me into a (closed/open) species-If you get a design from me, you are allowed to change the design in any way you see fit as long as you keep the original file with credit. When uploading to a site like toyhouse give me credit as the original designer and add on designers as the character changes.
-I am not responsible for any changes a buyer makes to a design after they get the creative lisence to a design (i.e. buying it).
-If you want to add changes to my design on my original image that is fine, just credit me for the base drawing and specify what changes you have added to it.
-I will not be providing an unwatermarked image for a design if it was not already included in the original upload.X. ADAPTION TO MY STYLEPlease take note that any characters that are usually drawn in a certain style (e.g. MLP or Sonic characters) will be adapted to my own style.At the moment, I am not open to commissions being drawn in another style other than my own/what you see in my gallery unless I am allowed to go experimental, but that must be stated beforehand. (this does not mean I will copy off another style however).I am also not open to directly referencing someone else's artwork without permission from the artist.X. AGE FOR COMMISSIONINGBy ordering anything from me, you agree that you are above the age of 18+ or have parental permission and guidance to pay. I will not sell NSFW (suggestive) artwork to minors.XII. WAIT TIMEA commission usually takes me from a few days up to 2 months to complete. (It COMPLETELY depends on my free time, motivation and the commissions size! - You are free to ask for an estimate!) I will be working on client commissions mostly during the weekends.♢ If a month has passed, feel free to DM me and ask me about the progress (not counting big bundles.)Waiting time on artist's side:
In case of unresponsiveness from the client's side, after the commission was started, (but is not yet finished), I will attempt contact multiple (at least 3 times) within 4 months. If the client does not respond after 4 months of the timeframe of the agreed upon commission, I will consider the commission cancelled. No refund will be given.XIII. CONTACTWhile I take most of my commissions over online social networks (Deviantart, Twitter, Newgrounds, Toyhou.se), I will also allow discord DM-s, for easier communication. Check information on my contact sub-page for where to find me.If you are commissioning big bundles, or a bigger piece, such as a reference sheet, please feel free to note me your Discord tag and I will add you for faster communication.XIIII. PIECES SPECIFICRe-posting artwork!You are allowed to re-post the WATERMARKED art piece in your gallery or other public sites (such as Toyhouse), if you are the client/commissioner and you must credit me. Please do not upload unwatermarked art for the public eye (you may keep it for personal reasons.).You are not allowed to sell or redistribute my content for monetary gain or use it for commercial means unless you receive written (and contracted) permission from me. (e.g. selling shirts, stickers, keychains with any of my art or designs present on them.)If you do not want your commission to be posted publicly by me, you must state so before I begin the piece! I may or may not post wips and finished works to Deviantart, Twitter, Newgrounds, other socials and private/public discord servers.Finished piecesI will not always post the commission online or post it as a stand-alone piece, it might end up in a bundle with other commissions on a bigger sheet or will not be posted in my galleries at all, so I condone you to save the separate image in each case, once you receive the artwork via sta.sh link, discord DM, email etc. (after some time these images may get deleted, specially off sta.sh, and I will not be able to retrieve the work.)The final piece sent will always be full resolution with watermark. If you wish for an unwatermarked one please tell me within 7 days of completing the final commission.I also retain the right to use commissioned work in my portfolio and other sheets as promotion.I will not sell any commissioned artwork to other customers and it will not be used for merch or any simmilarities (e.g. selling pins, stickers, shirts...)Editing my artworkPlease let me know beforehand if you (the client) plan on editing a piece I've made for you. Adding markings, changing proportions etc. fall into this category.I will 99% of the time allow it, but I would really appreciate knowing beforehand.Resizing or cropping (for an icon or such) is acceptable without permission.If you are editing a commission, please save the original image somewhere and state that the edited piece is edited and is not the original.
